My guess is that these two truisms will continue to divide the 17 or so guys who have continued to post here in the little playground that Herve has so graciously cobbled together for us. Maybe it's genetic. I don't know.
I do recall, though, from the work of a guy I used to associate with, that this phenomenon is well recognized, and that there are ways to protect against it.
Invariably, when drafting stay away orders, or cease and desist orders, or non-compete clauses, he would seek to include, in addition to a set number of years or even the life of the parties as the amount of time in question, some language to the effect that "this agreement will remain in effect, in perpetuity, and from now until the end of time."
"From now until the end of time" also seemed like absurd linguistic overkill.
But, as we see, who can say?
